Binding Agreement: These Terms constitute a legally binding agreement between you and maplediv. Your continued use of the Service after any modifications to these Terms constitutes acceptance of the updated Terms.

No Financial Advice: You acknowledge that maplediv is a portfolio tracking tool only. We do not provide financial advice, investment recommendations, or guarantee any investment returns. All investment decisions are your sole responsibility.

Service Description

maplediv provides a comprehensive platform for tracking dividend investments and portfolio management. Our services include:

  • Portfolio Management: Track holdings, shares, cost basis, and account types (TFSA, RRSP, Taxable)
  • Real-Time Stock Data: Integration with Yahoo Finance and TradingView for live market data
  • Dividend Tracking: Monthly/annual income calculations, yield tracking, and dividend history
  • MapleAudit: Comprehensive portfolio analysis with risk metrics, diversification scores, and CRA pattern indicators
  • MapleAI: AI-powered stock analysis and portfolio recommendations (Premium feature)
  • Analytics Dashboard: Sector allocation, account breakdown, performance metrics, and risk analysis
  • Finance Calculators: 25+ Canadian finance calculators (TFSA, RRSP, mortgage, tax, etc.)
  • News & Research: Stock-specific financial news aggregation and filtering
  • Watchlist: Track stocks of interest
  • Income Goals: Set and track dividend income targets
  • Backtesting: Historical performance analysis against benchmarks
  • Social Features: Public profiles and trending users (opt-in)
  • PDF Reports: Comprehensive portfolio analysis reports (Premium feature)
  • Earn Feature: Cryptocurrency mining dashboard and tracking

Service Limitations: You acknowledge that our Service is provided "as is" and "as available" without any warranties. We do not guarantee:

  • The accuracy, completeness, or reliability of any stock market data (which comes from third-party providers)
  • The accuracy of any calculations, analyses, or reports generated
  • Uninterrupted or error-free service availability
  • That the Service will meet your specific requirements
  • The security of data transmission over the internet
  • That third-party data providers (Yahoo Finance, TradingView, etc.) will always be available or accurate

User Responsibilities and Obligations

You agree to:

  • Provide accurate and complete information when creating your account
  • Maintain the security of your account credentials and notify us of unauthorized access
  • Use the Service only for lawful purposes and in accordance with these Terms
  • Not attempt to gain unauthorized access to our systems, databases, or other users' accounts
  • Not interfere with or disrupt the Service, servers, or networks connected to the Service
  • Not use automated systems (bots, scrapers) to access the Service without permission
  • Not reverse engineer, decompile, or disassemble any part of the Service
  • Not use the Service to transmit viruses, malware, or other harmful code
  • Comply with all applicable laws and regulations (Canadian and international)
  • Accept full responsibility for all financial decisions and their consequences
  • Verify all financial data independently before making investment decisions
  • Consult with qualified financial professionals for investment advice
  • Keep your portfolio data accurate and up-to-date
  • Respect intellectual property rights (ours and third parties')

You acknowledge that:

  • All investment risks are your sole responsibility
  • Past performance does not guarantee future results
  • Market data may be delayed or inaccurate
  • You are responsible for all tax implications of your investments
  • We are not liable for any financial losses you may incur

Financial Disclaimer: You expressly acknowledge that maplediv is not a registered investment advisor, broker-dealer, or financial planner. We do not provide personalized investment advice or recommendations. You are solely responsible for evaluating the merits and risks associated with any investment decision.

Limitation of Liability and Disclaimers

DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

LIMITATION OF LIABILITY

IN NO EVENT SHALL MAPLEDIV, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

Maximum Liability: Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or CAD $100, whichever is less.

Force Majeure: We are not liable for any failure to perform due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, fire, natural disasters, power failures, or internet outages.

Indemnification

You agree to indemnify, defend, and hold harmless maplediv, its officers, directors, employees, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or relating to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any applicable laws or regulations
  • Your investment decisions and their consequences
  • Any financial losses you may incur
  • Your failure to maintain account security
  • Any third-party claims arising from your use of the Service

Subscription and Payment Terms

Premium subscriptions are billed monthly through Stripe. Current pricing and features:

  • Free Tier: Basic portfolio tracking, limited PDF reports (7-day retention), 1 portfolio
  • Premium Tier: Full access to all features, unlimited PDF reports (365-day retention), MapleAI access, advanced analytics, 3 portfolios, priority support
  • Pricing: Premium subscriptions are billed at CAD $19/month (subject to change with notice)

By subscribing, you agree to:

  • Pay all fees associated with your subscription in advance
  • Provide accurate billing and payment information
  • Authorize recurring monthly charges to your payment method
  • Accept that subscription fees are non-refundable except as required by law
  • Cancel your subscription before the next billing cycle to avoid charges
  • Accept that subscription prices may change with 30 days' notice
  • Understand that cancellation does not entitle you to a refund for the current billing period

No Refunds: All subscription fees are non-refundable. We do not provide refunds for partial months, unused features, or dissatisfaction with the Service. Refunds may only be provided if required by applicable consumer protection laws in your jurisdiction.

Subscription Changes: We reserve the right to modify subscription features, pricing, or terms with 30 days' notice. Continued use after changes constitutes acceptance. You may cancel your subscription at any time through your account settings or by contacting us.

Intellectual Property

The Service and its original content, features, and functionality are owned by maplediv and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Our Rights:

  • All code, designs, logos, trademarks, and content are our exclusive property
  • MapleAudit, MapleAI, and maplediv are our trademarks
  • You may not copy, modify, distribute, sell, or lease any part of our Service without express written consent
  • You may not remove any copyright, trademark, or proprietary notices

Your Rights:

  • You retain ownership of your portfolio data and user-generated content
  • You grant us a license to use, store, and process your data to provide the Service
  • You may export your data at any time

Third-Party Content: The Service may include content from third parties (stock data, news, logos). Such content is owned by its respective owners and is subject to their terms of use.

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

  • Violation of these Terms or our Privacy Policy
  • Fraudulent, illegal, or unauthorized activity
  • Non-payment of subscription fees (after reasonable notice)
  • Abuse of the Service, other users, or our systems
  • Attempting to gain unauthorized access to our systems or other users' accounts
  • Using automated systems to access the Service without permission
  • Sharing your account credentials with others
  • Any activity that we determine, in our sole discretion, harms our Service or other users

Upon termination:

  • Your right to use the Service will cease immediately
  • We may delete your account and all associated data without notice
  • You will not be entitled to any refund of subscription fees
  • You remain responsible for any obligations incurred before termination
  • Provisions that by their nature should survive termination will remain in effect

Your Right to Terminate: You may terminate your account at any time by contacting us at maplediv@gmail.com or through your account settings. Upon termination, your data will be deleted according to our Privacy Policy.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Province of Quebec and the laws of Canada applicable therein, without regard to conflict of law principles.

Exclusive Jurisdiction: You agree that any disputes arising from these Terms or your use of the Service shall be resolved exclusively in the courts of Montreal, Quebec, Canada. You submit to the personal jurisdiction of these courts and waive any objections to venue.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by:

  • Posting the updated Terms on our website with a new "Last updated" date
  • Sending an email notification to your registered email address
  • Displaying a notice on the Service (for significant changes)

Continued Use: Your continued use of the Service after any changes constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service and terminate your account.
